AKTE 01.2 / FIKTIONSBESCHEINIGUNG

The Fiktionsbescheinigung, explained

A sheet of paper that stands in for your residence permit while the office decides. Whether you can keep working, and whether you can leave the country, comes down to which single box on it is ticked.

Your permit expires. The office has not decided. Now what?

German immigration offices rarely decide before your current permit runs out. The law fills that gap with a legal fiction: if you applied in time, your old permit is treated as still in force until a decision comes. The Fiktionsbescheinigung is the document that proves it — issued under § 81 AufenthG, usually as a paper sheet rather than a card.

Here is the part that catches people out. There is not one Fiktionsbescheinigung — there are three, printed on the same form, distinguished only by a ticked box. One carries your job and your travel rights across the gap. One carries neither. Most people never read which one they were given until an employer or an airline asks.

The one-line version

Apply before your permit expires and you keep your right to work and to travel while you wait. Apply after it expires and you lose both until the office decides. The date you file is worth more than anything you write on the form.

AKTE 01.2 / DIE DREI VARIANTEN

Three boxes, three completely different documents

§ 81 Abs. 4 S. 1 — Fortgeltungsfiktion

The good one. You applied before your permit expired, so the old permit counts as still running until the office decides. Your right to work continues exactly as it was — same job, same conditions, same restrictions. You may leave Germany and come back while the certificate is valid. If you are working and you travel, this is the box you need.

§ 81 Abs. 3 S. 1 — Erlaubnisfiktion

You were in Germany lawfully but held no residence permit — typically a visa-free national applying for a first permit from inside the country. Your stay is lawful while the application runs, but that is all it is. Work only if something separately allows it, and leaving Germany usually ends the practical benefit: lawful presence is not a residence title, so re-entry is not covered.

§ 81 Abs. 3 S. 2 — Duldungsfiktion

The one nobody wants. You applied after your permit had already expired, so the law suspends removal but does not make your stay lawful. No work, no travel, no re-entry. If this box is ticked and you believe you filed in time, that is worth challenging immediately rather than at your next appointment.

Check yours now, not later. Take out the certificate and find the paragraph printed on it. If it says Abs. 4 you are in the good case. If it says Abs. 3, everything you were planning to do — the trip home, the new contract, the job start date — needs checking against it first. The classification is a statement about your dates, and dates can be evidenced.

AKTE 01.2 / ECKDATEN

The numbers that decide it

Typical validity before it must be renewed

3–6 months

It is issued for a fixed period and extended if the office has still not decided. An expiring Fiktionsbescheinigung is normal; letting it lapse without contacting the office is not.

The deadline that decides which box you get

1 day

Applying the day before your permit expires puts you under § 81 Abs. 4 with your work and travel rights intact. Applying the day after drops you to § 81 Abs. 3 S. 2, with neither. Nothing else on this page matters as much as this date.

Your entitlement to the document itself

§ 81 (5)

The law says the certificate is to be issued — auszustellen. If the office has taken your application and will not give you the paper that proves it, that is a refusal you can push back on.

Typical municipal fee

~€13

Set locally, so it varies. It is an administrative fee for the document, not a charge for the decision on your permit.

Practice varies between offices. The statute is federal, but how a given Ausländerbehörde issues, dates and extends these certificates is local, and the figures above are the common case rather than a guarantee for your city. What does not vary is the effect of filing on time — which is the one thing entirely within your control.

How to keep the good version

Almost every bad Fiktionsbescheinigung story starts the same way: the application went in a few days late, or nobody can prove when it went in at all.

Get the application in, dated and provable

The fiction effect comes from filing in time, not from the certificate. An email with a timestamp, a posted application with proof of sending, or a booked appointment logged before the expiry date is what you will rely on later if the office reads the file differently.

Read the box before you leave the counter

Check which paragraph is ticked and whether the work line matches what your old permit allowed. Corrections are far easier the same day than three months later when your employer's HR has already flagged it.

Renew before it runs out

The certificate expires long before most offices decide. Track its date, request the extension in good time, and keep every piece of correspondence — a stalled file has legal remedies, but only if the record is clean.

AKTE 01.2 / STREITFÄLLE

When it goes wrong

Your employer will not accept it

A common and usually solvable problem. Under § 81 Abs. 4 the previous permit is treated as continuing, and the employment it allowed continues with it. HR departments that have never seen the document often read a missing plastic card as a missing right to work. The fix is showing which paragraph is ticked and what it carries over.

You applied late

Not automatically fatal. § 81 Abs. 4 S. 3 lets the authority order the continuation effect anyway where a late application would otherwise cause undue hardship. It is discretionary, which means it has to be asked for and argued — it will not be applied on your behalf while your file sits in a queue.

You hold a Schengen visa

The continuation effect does not apply to visas issued under § 6 Abs. 1 AufenthG. A short-stay Schengen visa does not roll over into a Fortgeltungsfiktion when you apply for something longer, which surprises people who assumed applying in time was enough.

Nothing has happened for months

Renewed certificates and silence are not the same as a decision, and the wait is not unlimited. Once a file has sat beyond a reasonable period there are formal steps that compel the office to answer. Knowing when that threshold is reached is the part worth a lawyer's hour.

AKTE 01.2 / DIE IDEE

Case turns your messy immigration situation into a lawyer-ready case file.

You know what you need before you pay.

Lawyers work on prepared cases, not messy ones.

For a Fiktionsbescheinigung that means the dates, the permit you held and the office’s own letters are already in order by the time a lawyer decides which fiction applies to you.

AKTE 01.2 / RECHTLICHE KLÄRUNG

Which fiction applies to you is a legal question

This page explains how § 81 AufenthG works in general terms. It is not advice about your case, and the difference between the three variants can turn on a single date in your file. Case is a case-preparation service, not a law firm: our AI builds and checks the file, and a licensed German immigration lawyer reviews it, decides what applies and signs it. Nothing is filed without a lawyer’s approval.

Straight answers about the Fiktionsbescheinigung

Can I work with a Fiktionsbescheinigung?

It depends on which box is ticked. Under § 81 Abs. 4 S. 1 (Fortgeltungsfiktion) your previous residence permit counts as continuing, so the employment it allowed — including any conditions attached to it — continues too. Under § 81 Abs. 3, whether as Erlaubnisfiktion or Duldungsfiktion, work is only permitted in exceptional cases. The certificate itself states what applies; read that line rather than assuming.

Can I travel and re-enter Germany with a Fiktionsbescheinigung?

Under § 81 Abs. 4 S. 1, yes — you may leave and return while the certificate is still valid, carrying it with your passport. Under § 81 Abs. 3 you generally cannot: lawful presence or suspended removal is not a residence title, and re-entry requires one. Travelling on the wrong basis can mean being refused boarding or entry, so confirm the paragraph before booking anything.

How long is a Fiktionsbescheinigung valid?

Usually three to six months. It is extended if the immigration office has not decided your application by then, and being extended more than once is common in busy cities. Its expiry date is not a deadline for your case — it is a deadline for the document, and you need to go back for a new one.

Is a Fiktionsbescheinigung a residence permit?

No. It is evidence of the legal effect your application already had, not a permit in its own right. The effect comes from filing in time; the certificate proves it to employers, banks, landlords and border officers. That distinction matters because the paper being late or missing does not remove a right you already hold — but proving it without the paper is considerably harder.

What if the wrong paragraph is ticked on my Fiktionsbescheinigung?

Raise it straight away. If you applied before your permit expired but the certificate cites § 81 Abs. 3 S. 2, your work and travel rights have been recorded away for the length of the process. This is corrected by showing the office proof of when you applied, which is why a dated, provable application matters more than anything else in the sequence.

What happens if my Fiktionsbescheinigung expires before the decision?

Contact the office before it lapses and ask for an extension — the underlying fiction effect runs until the authority decides, but you need current documentation of it. Turning up with an expired certificate is where avoidable problems with employers and travel start.

Does Case decide whether I have a Fiktionsbescheinigung?

No. Case prepares the case file — the application, the documents, the dated proof of filing and the timeline — and a licensed German immigration lawyer reviews and signs it. Which fiction applies to you is a question of law and of your dates, and it is answered by that lawyer, not by us.
